Terms and Conditions for TeamKazi

1. Acceptance of Terms

By accessing or using TeamKazi ("the Service"), you agree to:

  • Be bound by these Terms
  • Comply with Kenya's Data Protection Act (2019) and Computer Misuse Act (2018)
  • Warrant you are at least 18 years old

2. Service Description

TeamKazi provides:

  • Cloud-based task management tools
  • Team collaboration features
  • Integration with third-party services (PesaPal/Brevo)
  • Browser/web application access

3. User Obligations

You agree not to:

  • Share accounts or credentials
  • Use bots/scrapers to extract data
  • Upload illegal or harmful content
  • Reverse-engineer the Service (per Kenya's Copyright Act)
  • Violate any Kenyan laws through platform usage

4. Account Management

  • Registration: Requires valid Kenyan phone number or email
  • Termination: Users may request deletion via support@teamkazi.com
  • Inactivity: We reserve right to archive accounts inactive for 24+ months

5. Payments & Billing

  • Subscriptions: Monthly/Annual plans via PesaPal
  • Taxes: Inclusive of all Kenyan VAT/digital service taxes
  • Refunds: No refunds for partial months/accidental purchases
  • Free Trial: Automatically converts to paid plan unless canceled

6. Intellectual Property

  • We Own: Software code (Vue/Laravel), interface designs, documentation
  • You Own: User-generated content (tasks/comments/files)
  • License: Grant us non-exclusive rights to process your data for service delivery

7. Service Limitations

  • Availability: 99.5% uptime target (excluding scheduled maintenance)
  • Support: Email-only via support@teamkazi.com (9 AM - 5 PM EAT weekdays)
  • Backups: Daily system backups (user-uploaded files excluded)

8. Liability & Disclaimers

  • No Warranty: Service provided "as-is" without guarantees
  • Limitation: Maximum liability = 3x last monthly payment
  • Exclusions: Not liable for:
    • Data loss from user errors
    • Third-party service outages (PesaPal/Brevo/AWS)
    • Force majeure events (e.g., fiber cuts, power outages)

9. Termination

We may suspend accounts for:

  • Non-payment for 30+ days
  • Abuse reports verified by our team
  • Legal compliance requirements

10. Dispute Resolution

  • Mediation: Mandatory 30-day negotiation period
  • Jurisdiction: Exclusive to Kenyan courts in Nairobi County
  • Costs: Prevailing party recovers legal fees

11. Modifications

  • Notice: Changes emailed 30 days before taking effect
  • Continuation: Ongoing use constitutes acceptance

12. Governing Law

These Terms are governed by:

  • Kenya's Contract Law (Cap 23)
  • Electronic Transactions Act (No. 8 of 2020)
  • Data Protection Act (No. 24 of 2019)
